What is a car accident case worth? The three main factors are the severity of the injuries, the amount and invasiveness of the medical care, and the amount of the medical bills. This Costa Mesa case shows why: two people in the same rear-end accident settled their claims for very different amounts—$10,000 and $100,000.
Attorney Joseph Gallo of Gallo Law represented both the driver and passenger. They were in the same vehicle, both suffered neck and low-back injuries, both went to urgent care the same day, and the other driver accepted fault.
The biggest difference between the two cases was the medical care and medical bills.

What Were the Results of This Costa Mesa Car Accident Case?
Driver: $10,000 settlement
Passenger: $100,000 settlement
Accident: Rear-end collision
Location: Costa Mesa, California
Attorney: Joseph Gallo
Fault: Accepted by the other driver
Injuries: Neck and low-back injuries
The driver and passenger were riding in the same vehicle when another driver rear-ended them in Costa Mesa.
Both went to urgent care the same day.
After urgent care, the driver chose not to get additional medical treatment and ended up with only a couple thousand dollars in medical expenses.
The passenger continued treatment with a chiropractor, orthopedic doctor and pain management doctor and also had MRIs. The passenger ended up with about $30,000 in medical expenses.
The driver’s case settled for $10,000.
The passenger’s case settled for $100,000.
Why Was One Car Accident Case Worth $10,000 and the Other $100,000?
The biggest difference was the medical care and medical bills.
Many of the other important facts were the same. It was the same accident, the same vehicle and the same at-fault driver. Liability was accepted. Both people complained of neck and low-back injuries and both went to urgent care the same day.
But their medical treatment after that was very different.
The driver had only a couple thousand dollars in medical expenses. The passenger continued receiving treatment, had MRIs and accumulated about $30,000 in medical expenses.
That difference played a major role in why the two claims had such different values.
How Much Is My Car Accident Case Worth Right After an Accident?
If you were just in a car accident, it is usually too early to know exactly what your case is worth because some of the most important facts have not developed yet.
You may not know how serious your injuries are, what medical care you will need or how much your medical bills will be.
This case is a good example. On the day of the accident, both clients were in the same vehicle and both went to urgent care. At that point, you could not have known that one claim would eventually settle for $10,000 and the other for $100,000.

Should I Go to the Doctor After a Car Accident?
Yes. If you are hurt after a car accident, you should get appropriate medical care. The most important reason is your health. Some injuries may not seem serious immediately after a crash, and a medical professional can evaluate your symptoms and tell you what treatment you may need.
There is also another reason medical care matters: medical treatment tends to increase the value of a car accident settlement because it helps document the injuries and the amount of care the accident required.
Insurance companies look closely at medical records and medical bills when deciding what a car accident claim is worth. If there is little or no treatment, the insurance company may argue that the injury was minor or did not require much care.
This case shows the difference.
The driver went to urgent care but chose not to get additional treatment. The driver had only a couple thousand dollars in medical expenses and the case settled for $10,000.
The passenger continued treating with a chiropractor, orthopedic doctor and pain management doctor, had MRIs, and ended up with about $30,000 in medical expenses. The passenger’s case settled for $100,000.
That does not mean someone should get medical treatment they do not need. Medical care should be based on the person’s injuries and the recommendations of their medical providers. But when someone is actually injured, getting appropriate care also creates the medical records and bills that help show the insurance company the seriousness and value of the claim.
For context, the Insurance Information Institute reports that the average paid bodily injury auto liability claim was $28,278 in 2024. That is an industry average, not a prediction of what any individual case is worth.
What Factors Determine How Much a Car Accident Settlement Is Worth?
The three main factors are:
- Severity of the injuries
- Amount and invasiveness of the medical care
- Amount of the medical bills
Other factors can also affect the value of a car accident case, including vehicle damage, fault, insurance policy limits, lost income, prior injuries, available evidence and where the accident happened.
Location can matter because insurance companies consider where a case could eventually be tried. In our experience, Orange County cases tend to be valued less than Los Angeles County cases because Orange County juries tend to be more conservative in personal injury cases. A 2024 U.S. Chamber of Commerce Institute for Legal Reform report found that California had 199 reported verdicts of $10 million or more from 2013 through 2022, and that Los Angeles County accounted for over one-third of them. That does not directly compare Orange County to Los Angeles County, but it does show why Los Angeles is viewed as a venue capable of producing unusually large verdicts.
This case happened in Costa Mesa, in Orange County, which is another reason the location is part of the overall case evaluation.
There is no single settlement amount that applies to every car accident. If you want a fuller explanation of all the factors that can affect value, read Gallo Law’s guide to what a car accident case is worth.
How Much Can I Get for Being Rear-Ended?
There is no standard amount you can get for being rear-ended. A rear-end accident settlement depends on the injuries, medical treatment, medical bills, vehicle damage, insurance coverage, fault, location and other facts.
In this Costa Mesa rear-end accident, two people in the same vehicle received very different settlements: $10,000 and $100,000.
Can Two People in the Same Car Accident Get Different Settlements?
Yes. Two people in the same accident can receive very different settlements because each person has a separate injury claim.
In this case, the driver and passenger were injured in the same Costa Mesa rear-end accident. The driver had limited medical treatment and settled for $10,000. The passenger received substantially more medical care, had about $30,000 in medical expenses and settled for $100,000.
Do Medical Bills Affect a Car Accident Settlement?
Yes. Medical bills are one of the main factors that affect the value of a car accident settlement because they help show the amount of medical care caused by the injuries.
In this case, the driver had only a couple thousand dollars in medical expenses and settled for $10,000. The passenger had about $30,000 in medical expenses and settled for $100,000.
Does Going to Urgent Care After a Car Accident Increase the Settlement?
Going to urgent care creates a medical record showing that you reported injuries after the accident, but an urgent care visit alone does not determine settlement value.
Both clients in this case went to urgent care on the same day. One later settled for $10,000 and the other for $100,000 because their medical care and medical expenses developed very differently after that first visit.
Can I Know What My Car Accident Case Is Worth the Day of the Accident?
Usually not. The day of the accident, you may not yet know the severity of your injuries, the treatment you will need or the amount of your medical bills.
That is exactly what happened in this case. Both clients went to urgent care on the day of the crash, but their claims later developed differently and settled for $10,000 and $100,000.
